1. SCOPE

These terms and conditions apply to all orders placed through our online shop. Our online shop is exclusively intended for consumers.

Consumers are defined as consumers within the meaning of the Consumer Protection Act (KSchG) and, in accordance with § 13 BGB, any natural person who enters into a legal transaction for purposes that can predominantly neither be attributed to their commercial nor their independent professional activity. An entrepreneur is a natural or legal person or a legal partnership with legal capacity that acts in the course of its commercial or independent professional activity when concluding a legal transaction.

2. CONTRACTING PARTY, CONCLUSION OF CONTRACT, CORRECTION OPTIONS

The purchase contract is concluded with oeá J. u. A. Bader GbR.

By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained for this purpose in the ordering process. The contract is concluded by clicking on the order button to accept the offer for the goods contained in the shopping cart. Immediately after sending the order, you will receive a confirmation by email.

4. DELIVERY TERMS

In addition to the indicated product prices, shipping costs may apply. You can find more details about any shipping costs in the offers.

5. PAYMENT

In our shop, you can generally use the following payment methods:

  • Credit card By placing the order, you provide your credit card details. Your card will be charged immediately after placing the order.

  • PayPal Express To pay the invoice amount via the PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal") payment service, you must be registered with PayPal, authenticate yourself with your access data, and confirm the payment instruction.

  • Sofort by Klarna To pay the invoice amount via the payment service provider Sofort GmbH, Theresienhöhe 12, 80339 Munich, you must have an online banking-enabled bank account, authenticate yourself accordingly, and confirm the payment instruction. Your account will be charged immediately after placing the order. Further information can be found during the ordering process.

  • Google Pay To pay the invoice amount via the payment service provider Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland ("Google"), you must be registered with Google, have activated the Google Pay function, authenticate yourself with your access data, and confirm the payment instruction. The payment transaction will be carried out immediately after placing the order. Further information can be found during the ordering process.

  • Apple Pay To pay the invoice amount via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the "Safari" browser, be registered with Apple, have activated the Apple Pay function, authenticate yourself with your access data, and confirm the payment instruction. The payment transaction will be carried out immediately after placing the order. Further information can be found during the ordering process.

  • Cash payment upon collection You pay the invoice amount in cash upon collection.

6. TRANSPORT DAMAGE

If goods are delivered with obvious transport damage, please report such errors to the deliverer as soon as possible and contact us immediately. Failure to make a complaint or contact us will not have any consequences for your legal claims and their enforcement, especially your warranty rights. However, you will help us to assert our own claims against the carrier or transport insurance.

7. WARRANTY AND GUARANTEES

Application of statutory warranty rights

8. LIABILITY

We are always liable for claims based on damages caused by us, our legal representatives, or vicarious agents:

  • for injury to life, body, or health,
  • for intentional or grossly negligent breach of duty,
  • for guarantees, if agreed, or
  • to the extent that the scope of application of the Product Liability Act is opened.

In the event of a breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract and on which the contractual partner may regularly rely (cardinal obligations) by slight negligence on our part, our legal representatives, or vicarious agents, liability is limited to the amount of damages that must typically be expected to occur at the time of the conclusion of the contract.

In all other respects, claims for damages are excluded.

9. DISPUTE RESOLUTION

The European Commission provides a platform for online dispute resolution (OS), which you can find here [https://ec.europa.eu/consumers/odr/]. We are not obliged and not willing to participate in a dispute resolution procedure before a consumer arbitration board.

If you are an entrepreneur, German law applies, excluding the UN Sales Convention.
